New Section 28 Regulation (O. Reg. 41/24)

Effective April 1, 2024, changes to the legislative and regulation framework of the Conservation Authorities Act will require KCCA to review and update its policies and procedures, and regulatory mapping. The new Ontario Regulation 41/24: Prohibited Activities, Exemptions and Permits will replace KCCA’s existing “Development, Interference with Wetlands and Alterations to Shorelines and Watercourses” (Ontario Regulation 181/06).

O. Reg. 41/24 is a consistent regulation now used by all 36 Conservation Authorities in Ontario.

The new regulation continues to regulate development and alteration activities in or adjacent to hazardous lands such as floodplains, river and stream valleys, wetlands and areas that are adjacent or close to the shoreline on the Great Lake-St. Lawrence River System or to inland lakes.

KCCA will need time to update its Policies, Procedures and mapping to reflect the new Regulation. Therefore, interim policy guidelines were approved on March 27, 2024, to be in effect until the new policies, procedures and mapping can be drafted. The public will have an opportunity to review the updated documentation and mapping before it is approved by the Board of Directors.

  1. Review Ontario Regulation 41/24.
  2. Review the Conservation Authorities Act.
  3. Review board reports on the new Regulation and required changes.
  4. Review KCCA’s Interim Policy Guidelines.
  5. Review KCCA’s Permit Application Package.
  6. Email written questions or concerns to Maisa Fumagalli, Planning & Regulations Supervisor.
